International Disputes

 

The firm regularly litigates cases on behalf of non-United States entities and individuals in California courts.  It has significant experience in the special challenges these disputes involve.

Typically, international disputes are litigated in federal court, as opposed to state court, assuming the parties are from different countries and the amount in dispute exceeds $75,000.

The firm has represented foreign parties in significant business disputes in federal court, state court, arbitration and mediation.

In several cases, the firm’s lawyers have been able to recover significant judgments and settlements, or impressive defense results, including the following:

​

• Won summary adjudication for an Israeli corporation holding promissory note, including principal and several years of interest, in a federal court case;

• Won arbitration trial, leading to award in excess of $1.2 million for Jerusalem resident; defeated $3 million cross complaint;

• Obtained large settlement for Israeli exporter of goods to California, in federal court lawsuit; lien placed on sale of defendant’s company, leading to negotiated resolution;

• Recovered entire investment with interest and partial attorneys fees for defrauded Tel Aviv real-estate investor; and

• Defeated $2 million claim by publicly traded company against former California executive.

 

As with almost all cases, client communication is the most important factor in leading to a successful result.  Because English is the international language of trade, translation expenses are usually minimal.  However, there is a need to bridge cultural issues, especially clarifying the American judicial system, which is often different from other judicial systems.
